How the site works

This section sets out the conditions under which listings are referenced, removed and ranked on the website www.trackstone.fr (the "Site"), published by Trackstone ("Trackstone"). It complements the Site's terms of use and legal notice.

1. REFERENCING OF LISTINGS

1.1 Status of the advertiser

The listings displayed on the Site (the "Listings") for its users (the "Users") are published by Trackstone, a licensed real estate agency, on behalf of owners who have entrusted it with a sales mandate (the "Sellers"). For every Listing, the advertiser is therefore a real estate professional subject to French law no. 70-9 of 2 January 1970. Sellers may be private individuals or professionals.

Trackstone does not display Listings from third-party advertisers and does not sell any advertising space in its search results.

1.2 Publication

A Listing goes online once the mandate is signed, the property's essential information is entered (address, price, surface, rent, current lease, diagnostics) and that information has been checked by Trackstone on the basis of the documents provided by the Seller.

1.3 Removal

A Listing is removed from the search results when the property is under an accepted offer or sold, or when the mandate ends.

1.4 Rights and obligations of the parties

The sale is concluded between the Seller and the buyer, Trackstone acting as the Seller's agent; it is recorded by a notarial deed. When the Seller is a private individual, the buyer does not benefit from the guarantees specific to sales concluded with a professional, but keeps the guarantees provided by the French Civil Code (warranty against eviction, warranty against hidden defects) under the terms set by the deed of sale, as well as, for a dwelling, the statutory cooling-off period granted to non-professional buyers. When the Seller is a professional, the pre-contractual information that falls on them is provided to the buyer in the Listing and the sale file. Transfer duties are borne by the buyer and any capital gains tax by the Seller, in accordance with the applicable regulations.

2. RANKING OF LISTINGS

2.1 The User may customise the sort order according to the following criteria:

• Price ascending / descending
• Gross yield ascending / descending
• Net yield ascending / descending
• Date

The filters applied by the User (location, budget, yield, property type) apply whatever the chosen sort.

2.2 Default ranking

The default sort of the Listings (called "Sélection") on the Site's results page is the display order that applies automatically as long as the User has not customised their sort.

By default, Listings are displayed in the following order of priority:

1. Featuring by Trackstone

Trackstone may decide to place one or more Listings temporarily at the top of the results, in particular when they go online or following a price revision. This featuring is an editorial choice by Trackstone and involves no payment from the Seller.

2. Time online and visibility of the Listing

Among the other Listings, priority is given to those that have been online the longest and viewed the least recently, so that every property receives fair exposure. A Listing that has just gone online, or whose price has just been revised, nevertheless keeps enhanced visibility for a limited period.

3. Quality of the Listing

With comparable time online and visibility, Listings are prioritised according to their quality. The more complete and illustrated the property's page, the higher the Listing is ranked in the Site's results.

With equivalent criteria, the order is refreshed randomly every day so that the results vary from one visit to the next. Listings for a property under an accepted offer or sold, when still displayed, appear at the end of the list.

2.3 Suggestions

On each property page, the User is offered Listings likely to be of interest (called "Similar properties"). These suggestions are selected according to the location, price and type of the property viewed.
